El arbitraje y la TI. Formato de documento portátil (.pdf). Leer, marcar y anotar con inteligencia

En el análisis de los medios que la TI ofrece para el trabajo legal, no me ocuparé de los procesadores de palabras, tales como Microsoft Word o Pages. Hoy en día todos los usan. Alguna diferencia puede haber entre los que escriben directamente a la computadora y quienes los usan como máquinas de escribir a cargo de sus secretarías, a las que les dictan del modo que era tradicional.

Un primer argumento de los que no aceptan la TI, es que están acostumbrados a leer en papel, que les gusta el olor y el sabor del papel, sentirlo, y otras bellezas por el estilo. En materia de gustos no hay discusión: cada quien tiene los suyos. Pero cuando voy a un concierto escojo lo que más disfruto, y cuando trabajo lo que más produce.

Un argumento frecuente de quienes rechazan la TI, y en apariencia sólido, es que cuando leen necesitan hacer notas, subrayados, etcétera. Para ello necesitan el soporte documental. Si intento convencerlos de que todo lo pueden hacer con la TI, y con ventajas, encuentro oídos sordos. 

Pero la posibilidad de escribir todas las reacciones que la lectura nos provoca está disponible en los documentos de la TI, y con mayor productividad que en el papel. En los documentos informáticos, se pueden hacer mejores anotaciones, con mas facilidad; y tenerlas disponibles en cualquier momento.

Documentos PDF

En esta entrega me limitaré a explicar que es un documento hecho con el "formato de documento portátil" y algunas de sus ventajas para el trabajo legal. 

El PDF es el formato predominante hoy en día. Es un formato que presenta cualquier documento en una manera independiente de la aplicación de software, hardware u sistema operativo. Incluye el texto, las fuentes, gráficas y cualquier otra información necesaria. Se identifica por la terminación ‘.pdf’ (por 'Portable Document Format'), del archivo electrónico. 

Adobe Systems es el inventor del PDF, que ha perfeccionado durante más de 20 años. Es un estándar abierto para el intercambio de documentos electrónicos que mantiene la Organización Internacional de Normalización (ISO). 

Al convertir documentos, formularios, gráficos y páginas web a PDF, su aspecto será igual al de los documentos impresos; pero con múltiples ventajas. Los archivos PDF pueden contener vínculos y botones para darles clic, campos de formulario, vídeo y audio, etcétera.

Es el formato estándar en todo el mundo para intercambiar documentos con la mayor seguridad. Recurriendo a contraseñas, se pueden limitar el acceso, la copia, la edición y la impresión de documentos. Aunque no son recomendables los extremos que se constituyan obstáculos al trabajo legal eficiente. 

Comentarios y marcas

Me referiré a las objeciones sobre comentarios y marcas en los documentos. Quienes ponen objeciones, se sorprenderían gratamente si aprendieran y practicaran las bondades de los documentos PDF.

Los comentarios que siguen corresponden a lo que se puede hacer con el programa Adobe Acrobat Pro 11. Adobe ofrece varias opciones gratuitas para la lectura de archivos PDF. Un profesionista serio no debe ahorrar usando versiones gratuitas, sino que debe comprar el software que le permita hacer su trabajo con eficiencia.

‘Post it’ y otras marcas

Al leer un documento en formato PDF, se pueden escribir notas de las llamadas “post it’ (notas adheribles). Posteriormente, las notas se pueden consultar, modificar, reemplazar o eliminar. Su texto, en todo o en parte, se puede copiar y pegar en otro documento y hacer con él muchas otras operaciones. Son mis preferidas.

Con la misma facilidad, se puede subrayar el texto, o marcarlo como si fuera con un marcador de papel. Se pueden aplicar varios colores y formatos. También se pueden señalar con rayas laterales, cuadros de texto, flechas, añadir comentarios de texto mecanografiado o, incluso, manuscrito (usando la herramienta ‘lápiz”). Son igualmente identificables y, como todas las otras anotaciones, se pueden modificar, reemplazar o eliminar.

También se pueden hacer o sugerir ediciones, tales como insertar, reemplazar o eliminar texto. Y añadir notas ‘post it’ a cada una de las marcas.

Se pueden insertar grabaciones; por ejemplo, dictar notas en lugar de escribirlas. Se pueden insertar fotografías, diagramas, páginas web, etcétera.

También se pueden agregar marcadores informáticos (‘bookmarks’), para localizar los lugares en donde se tratan temas sobre los que se prevea la necesidad de regresar. Por ejemplo, indicando el número de página o sección, así como el tema ('excepciones, página 45’).

Búsquedas

Uno de sus grandes atractivos es la sencillez y rapidez de las búsquedas de texto y anotaciones. Se hace en segundos, a condición de: (i) usar buenas estrategias; (ii) saber como hacerlo; y, (iii) practicar. Ya hablaré de estas estrategias.

Además, los documentos PDF de Adobe tienen una barra que muestra todas las anotaciones hechas en el documento. 

Firma

Es fácil firmarlos de forma electrónica. Se puede añadir la imagen de la firma, crear una firma especial o usar las técnicas informáticas. Aunque esta formalidad no sea necesaria, como lo demostraré cuando comente la regulación legal.

Revisión y lectura

Un buen lector, como un buen conversador, primero escucha. La posibilidad que brinda la TI de hacer tantas anotaciones, como todos los abusos, puede ser ocasión de males. Conozco lectores que se ponen a leer con el lápiz en la mano. Mala señal. 

Es un error. Para anotar o reaccionar recomiendo prudencia. El exceso de notas, subrayados, marcas, signos de admiración, etcétera, en lugar de apoyo es un obstáculo. No es aconsejable usar todas las posibilidades de anotar y marcar; mas bien, seleccionar unas cuantas y usarlas con consistencia. Quien mucho abarca, poco aprieta; me ha llevado mucho tiempo aprender esto.

La primera lectura me sirve para escuchar; me interesa mas comprender que reaccionar. Si hago anotaciones, son mínimas. La segunda lectura, es analítica. Es cuando apunto, o marco, reacciones, ideas, dudas, desacuerdos, marcas para regresar a lugares importantes, etcétera. En sucesivas lecturas y en la preparación y revisión de resoluciones, memoriales u opiniones, las anotaciones cumplen su cometido y me resultan muy útiles. Seguramente que añadiré algunas, modificaré otras y no serán pocas las que me sean indiferentes.

Conversión a PDR

Prácticamente todos los programas tienen una herramienta que permite crear una versión en PDF. La uso constantemente.

Por ejemplo, en días pasados recibí un proyecto de orden procesal que nos sugiere el presidente del tribunal. Nos la envió en Microsoft Word. La convertí en PDF, hice mis anotaciones y remití el archivo PDF a mis coárbitros, que las podrán considerar para el texto definitivo.

Tabletas y teléfonos inteligentes

Todo lo anterior sería poco útil si sólo lo pudiera hacer en la computadora, sea de escritorio o portátil. Los documentos PDF son muy útiles en las tabletas e, incluso, en los teléfonos inteligentes.

Existen programas que pueden hacer en las tabletas o teléfonos todo lo que arriba describí. Hay muchas. Son muy usadas; mis preferidas son Evernote y GoodReader. También he usado, con mucho provecho, iAnnotatePDF, PDFReader Pro y Penultimate.

Puedo descargar en la iPad los documentos PDF que almaceno en Dropbox o en Evernote. Igualmente, puedo subir a Dropbox o guardar en Evernote los documentos PDF que trabajé en mi iPad. En el momento en que están en línea, se sincronizan y todo queda uniforme. En todo momento y en todo lugar tengo mi información a la mano y puedo trabajar en ella.

IT and Arbitration. Portable Document Format (.pdf).  Read, Mark and Take Notes Intelligently


I skip word processors, like Microsoft Word or Pages. Nowadays everybody uses one or two of them. Perhaps only to point out that some use them to write directly in the computer and for others they are no more than a kind of modern typewriter in the hands of their typist help, to whom they dictate as in old days.

Those who reject or ignore IT argue that they prefer paper; they are used to read it, smell it, taste it, feel it and other beauties. Disputes on preferences are not proper; everybody likes what they like. But when I go to a concert I choose what I enjoy and when I work I choose what is productive.

A frequent objection of those who reject IT is that when they read, they need to take notes, highlight information, etc. They need hard copies. That sounds as a strong argument, but it is not. When I try to make them realize that they can do the same with IT and with more advantages, I find deaf ears.

The fact is that IT allows all those possibilities, and in a better manner than in paper. Annotations can be easily made in electronic documents, and they are available together with markings at any time. Certainly, they are a betterment of a printed document.

PDF Documents

In this post I will restrict myself to documents with 'Portable Document Format' and some of their benefits for the legal work.

PDF is the most used format nowadays. This format can present any document regardless of the software, hardware or any other operating system. It includes text, source, graphics and any other necessary information. It is identified by the termination .pdf ('Portable Document Format') in the file.

PDF was created by Adobe Systems. It has improved it for the last 20 years and has become an open standard for the exchange of documents supported by the International Organization for Standardization (IOS).

Documents, forms, graphics and web pages in PDF look the same as hard copies, but with advantages. The PDF files can get links, buttons to click them, form fields, video, audio, etcetera.

At this time PDF is the most secure format to exchange documents around the world. You can use passwords to limit the use, copy, editing and printing the documents. However, extremes in security are not advisable when they create obstacles for an efficient legal work.

Marks and Comments

As objections arise out of the need to mark and comment I will make another restriction and will refer only to those operations. People that are mentally blocked to IT would be surprised by its benefits, only if they should learn and practice the use of PDF documents.

The next ideas are based in what you can do with Adobe Acrobat Pro 11. Adobe offers several free options to read PDF files. But serious professionals should not use free versions; they should buy the software that allows them to work efficiently.

“Post it” and Other Marks

When reading a PDF document it is possible to write 'post it' notes on it. Later you can see, modify, change or eliminate the ‘posts it’. You can copy, paste and make other actions with all the text or a part of it in other documents. 'Posts it' are my favorites.

PDFs may be underlined or marked as if you were using a text marker in paper. You also can choose between different colors and formats, mark with lateral lines, text boxes, and arrows. Also type text or even written text (using the ‘ pencil' tool) may be added. All those marks are easily searchable, and can be modified, changed or deleted.

Making and suggesting editions, like inserting, replacing or eliminating text are easily made. And add 'post it' notes to each mark.

Similarly, recordings and illustrations may be added in PDFs. For example, voice notes instead of written notes; photographs, diagrams, web pages, etcetera.

Very useful are the bookmarks that identify places where it may be needed to return for any topic; for example indicating the page number or section, even the topic ('defenses, page 45'). 

Searches

The simplicity and quickness of searches of text or notes is very attractive. You can get them in a few seconds, on condition that: (i) good strategies are used; (ii) you know how to do them; and (iii) practice. I will talk about some strategies later.

Additionally, the PDF documents have a bar that shows in a glance all the notes and marks in the document.

Signatures

Signing documents electronically is easy. You can add an image of your signature, make a special one or apply electronic techniques. This formality is not legally needed, as I will explain later when dealing with the legal framework.

Reading and Reviewing

A good reader, as a good conversationalist, listens first. The availability of such a battery of annotations tools should not be abused. I know people that seat to read with the pencil at hand; that is a bad signal.

It is a mistake. Prudence is needed when you make notes and react. The excess in notes, underlines, marks, exclamation marks, etcetera, can become an obstacle. Selecting the tools to make notes and marks, and using them consistently, is better than resort to all of them indiscriminately. A popular expression in Mexico says that: he who covers much, seizes. It took to me a long time learn it.

My first reading is for listening; I prefer first to understand than to react. Thus I make just a few notes, if any. My second reading is analytic. Then I write, or mark, reactions, ideas, doubts, disagreements, bookmarks, etc. These notes become very useful on my next readings, when preparing, editing or revising resolutions, memorials or opinions. Certainly that I will add some, change others and find others irrelevant.

PDF Conversion

Almost all applications allow the making of a PDF version of the document at hand. I rely in this strategy very often.

For example, a few days ago, the chairman of an arbitral tribunal in which I am seated, sent me a draft procedural order. It was in Microsoft Word. I converted the file into a PDF one, made my notes and sent it to my coarbitrators so they could consider them for the final version.

Tablets and Smartphones

All I have been talking about would be of little use if I could only do it in a desk computer or in a laptop. But PDF documents are very useful in tablets and smartphones.

There are some applications that serve for the same purposes as described above. There are many. Very popular, and my favorites are Evernote and Good Reader. I have also used iAnnotatePDF, PDFReader Pro and Penultimate.

I can download all the documents I have in Dropbox or Evernote in my iPad and can upload the documents I worked in the iPad to Dropbox and Evernote as well. When I am online, all the devices synchronize and everything becomes uniform. This way I have all my information available everywhere and at anytime.

I will continue with other applications.
